Brazil enacts Redata law to support data-centre investment

Brazilian President Luiz Inácio Lula da Silva signed the Redata special tax regime for data-centre services into law on 15 September. The programme exempts eligible information and communications technology equipment used to build, modernise or expand data centres from PIS/Pasep, Cofins and IPI taxes. Equipment without an equivalent made in Brazil is also exempt from import duty.
Companies using the incentives must invest 2% of the value of purchased products in research, development and innovation projects that strengthen Brazil’s digital-economy supply chain. They must also make at least 10% of their processing, storage and data-treatment capacity available to the Brazilian market. For projects in the North, Northeast and Centre-West, both requirements may be reduced by 20%; water-efficiency and sustainability conditions also apply.
