Brazil’s National Electric Energy Agency (ANEEL) approved on 20 October a public consultation on how tax reform affects regulated remuneration bases for electricity concessionaires. The reform replaces PIS/PASEP and COFINS with CBS and IBS under Complementary Law 227/2026.

The agency proposed a temporary financial component to deduct tax credits from assets acquired before the reform, avoiding duplicate recovery, and a net-of-tax basis for sharing distributors’ ancillary revenues. For transmission, it suggested a specific adjustment component on allowed revenue. Comments may be submitted from 21 to 30 October; these are consultation proposals, not final rules.
