The UK Treasury opened a consultation on 28 October on a statutory tax regime for foreign sovereign investors, planned from 1 January 2029. Responses are requested by 20 January 2027. The proposal would replace the current non-codified sovereign-immunity approach to direct taxation.
The government expects the main effect to be taxation of certain returns from directly held UK real estate, with trading income affected in limited circumstances. Investments through UK companies already subject to corporation tax would not be newly brought into that tax solely because of the status change.
The framework proposes tailored access to real estate investment trusts, a 15% rate under specified arrangements, and exemptions for qualifying investment offices and state-operated overseas pension funds. Further technical consultation and legislation would follow. The planned regime is not an immediate tax charge on every sovereign investment.
