Attorney General Ellie Reeves issued updated guidance on 8 September for government lawyers assessing the legality of policy and operational decisions. It sets out a framework for explaining legal risks and identifying practical ways to reduce them.
The guidance says a decision is not unlawful merely because litigation risk is high when a tenable legal argument exists; ministers must receive a full assessment of that risk. It is now in operation across departments, replaces the 2024 version and specifies when sensitive or disputed questions should be escalated to the Law Officers.
