A new measure that took effect in England on 5 October requires courts to state in open court and record at sentencing when domestic abuse was a factor in an offence. Although abuse was already treated as an aggravating factor in many offences, there had been no consistent single record after conviction.

The new judicial finding will be visible across police, prison and probation systems. The Ministry of Justice says it should help agencies identify repeat patterns, assess risks posed by perpetrators and tailor interventions. The requirement was introduced by the Sentencing Act 2026 and added to the Criminal Procedure Rules.
